Is there possibility for a law suit here?

k well my 17 year old brother happened to be sick for 2 weeks he wouldnt eat or sleep in 10 days he was rushed the the er where he has now been for 4 days they say its going to be another 3-5 at least before he can leave it turns out that there was pigeon poop bateria in his eye and it caused his whole eye to sweel up to the size of a baseball and his face is purple and red. we live in a apt and there is a ladder to get to the roof for maintence above are walkway and pigeons sit there and have **** on the walk path that is like 2 feet in front of the frontdoor and we have told them to clean it up they did once but now its came back and has been there for about 3 weeks now.. after they had cleaned it up the first tiem and came back is when all this happened could this be a lawsuit? if so like 1k payout? it went to the optical nerve that goes to his brain and almost was to the brain
